CarFai Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CarFai mobile application and related services (the "Service") provided by CarFai ("CarFai", "we", "us", "our").
By creating an account, downloading the app, or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent that you meet this requirement.
If you are using the Service on behalf of an organization (B2B accounts), you represent that you have authority to bind that organization to these Terms.
2. Account registration
You may register for an account using:
- Email and password
- Apple Sign In
- Google Sign In
- Microsoft Sign In
You are responsible for maintaining the confidentiality of your credentials. You must promptly notify us at [email protected] if you suspect unauthorized access. You are responsible for activities that occur under your account.
You agree to provide accurate, current information at registration and to keep it accurate.
3. Service description
CarFai is a mobile application providing:
- Vehicle and document management
- AI-powered vehicle analysis, maintenance recommendations, and valuation guidance ("AI Advisor")
- Document scanning and structured extraction
- OBD2 diagnostic integration
- Multi-vehicle and B2B fleet management features (paid tiers)
- Subscription management
We may modify, suspend, or discontinue any feature at any time, with reasonable notice for paid features. We will not retroactively reduce the substance of features paid for during an active subscription period.
4. Subscriptions and payments
4.1 Subscription tiers
CarFai offers free and paid subscription tiers. Current tiers and pricing are available at https://carfai.app/pricing and at the in-app paywall. Pricing varies by region.
4.2 Payment processing
All payments are processed by Apple App Store (iOS) or Google Play (Android). CarFai does not directly handle payment cards. By subscribing, you agree to the relevant store's payment terms in addition to these Terms.
4.3 Free trial
Some subscription tiers offer a 3-day free trial. The trial begins when you subscribe with a trial-eligible plan. If you do not cancel before the trial ends, your subscription auto-renews at the regular rate.
You may use a trial only once across all CarFai subscription tiers per your Apple ID or Google account, regardless of cancellation. This restriction is enforced by Apple and Google.
4.4 Auto-renewal
Subscriptions auto-renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period. You can cancel at any time via your Apple App Store / Google Play subscription settings.
4.5 Cancellation and refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until then, then revert to the free tier. We do not provide refunds for partial periods, except where required by law.
For refund requests, contact Apple or Google directly (CarFai cannot process refunds for store-billed subscriptions). Refund policies are governed by Apple's and Google's terms.
4.6 Plan changes
When you upgrade, the new plan takes effect immediately. When you downgrade, the change takes effect at the end of the current billing period. Token allocations and feature access adjust accordingly.
4.7 Power User Bundle (one-time purchase)
The Power User Bundle is a one-time purchase that grants 2 million AI tokens, valid until consumed. It is not a subscription and does not auto-renew. Once tokens are consumed, you may continue using free-tier features or subscribe to a paid tier.
4.8 EU consumer 14-day right of withdrawal (digital content)
If you are a consumer located in the European Economic Area, the United Kingdom, or Switzerland, the EU Consumer Rights Directive (and equivalent UK / Swiss law) gives you a 14-day right of withdrawal from a digital-content purchase. This applies to the Power User Bundle (Section 4.7).
Because the Bundle delivers immediate access to digital content (your AI tokens become spendable the moment the purchase completes), the right of withdrawal lapses only if you have expressly waived it at the time of purchase, and expressly acknowledged that you lose the right by doing so. CarFai will present a clear waiver checkbox during the Power User Bundle checkout flow. You may decline the waiver:
- If you waive: tokens are immediately usable; no refund right under the EU 14-day rule (your other consumer rights are unaffected).
- If you do not waive: tokens are still immediately usable, but you may request a full refund within 14 days of purchase. Refund will be issued via the original payment method (Apple App Store or Google Play, who handle the actual refund per their terms). Your
lifetime_balancetoken allocation will be reversed; tokens already consumed during the 14-day window are NOT charged back to you.
For subscriptions (Sections 4.1-4.6), the 14-day right does NOT apply once a billing period has begun, per Article 16(m) of the Consumer Rights Directive (digital content delivered with explicit consent). Cancellation works as described in Section 4.5.
5. AI Advisor and automated outputs — IMPORTANT DISCLAIMER
The AI Advisor uses artificial intelligence (Anthropic Claude) to generate responses. AI-generated outputs:
- MAY BE INCORRECT, INCOMPLETE, OR OUT OF DATE.
- ARE NOT a substitute for professional advice from a qualified mechanic, lawyer, accountant, financial advisor, or insurance professional.
- MUST NOT be relied on for safety-critical decisions, including but not limited to:
- Whether a vehicle is safe to drive
- Whether to ignore an active warning light or DTC
- Medical, legal, financial, tax, or insurance advice
- Decisions in transactions where errors could cause material loss
You are solely responsible for verifying any AI-generated information against authoritative sources before acting on it. CarFai disclaims all liability for actions taken based on AI Advisor outputs to the maximum extent permitted by law.

6. OBD2 integration disclaimer
The optional OBD2 features connect to a Bluetooth OBD2 adapter you provide. Use of OBD2 features:
- May be illegal in some jurisdictions while driving — do not use the Service while operating a vehicle.
- Does not guarantee detection of all vehicle issues.
- Does not replace professional diagnostic services.
- Is provided "as is" without warranty of compatibility with your specific vehicle.
CarFai is not responsible for damage to your vehicle or adapter, or for incorrect diagnostic information.
7. Vehicle valuation disclaimer
The AI Advisor and CarFai's valuation features provide estimated vehicle values based on user-provided data, public market signals, and AI inference. Estimated values:
- Are not formal appraisals.
- Should not be used as the sole basis for transactions (sale, purchase, insurance claims, financing, tax filings, legal proceedings).
- May differ materially from prices realized in actual transactions.
For binding valuations, consult a licensed appraiser.
8. User content
You retain ownership of vehicle data, documents, photos, and other content you upload ("User Content"). You grant CarFai a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and modify User Content solely as necessary to provide the Service.
You represent that you have the right to upload all User Content and that doing so does not infringe any third party's rights.
We do not claim ownership of User Content. Upon account deletion, we delete your User Content per the Privacy Policy retention schedule.
9. Acceptable use
Your use of the Service is subject to the Acceptable Use Policy at https://carfai.app/aup (or in docs/legal//aup). Prohibited uses include:
- Illegal activity
- Harassment or abuse of other users
- Attempts to circumvent access controls, RBAC, or token limits
- Automated scraping
- Prompt injection or other attacks against our AI systems
- Reverse engineering except as expressly permitted by law
Violations may result in immediate account termination without refund.
10. Intellectual property
The Service, including its software, design, content (other than User Content), trademarks, and logos, is owned by CarFai or its licensors and protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
You may not:
- Copy, modify, distribute, sell, or lease any part of the Service.
- Reverse engineer or attempt to extract source code (except as permitted by applicable law).
- Remove or obscure any proprietary notices.
11. Third-party services
The Service relies on third-party services including Apple, Google, Anthropic, Supabase, RevenueCat, and Resend. Your use of these third-party services is subject to their respective terms and privacy policies. CarFai is not responsible for third-party service availability or actions.
12. Termination
12.1 By you
You may terminate your account at any time via the in-app "Delete account" flow or by contacting [email protected].
12.2 By us
We may suspend or terminate your account if:
- You materially breach these Terms or the Acceptable Use Policy.
- Your account is implicated in fraud, security incidents, or abuse.
- We are required to do so by law.
- We discontinue the Service entirely (with reasonable notice).
We will give you reasonable notice and the opportunity to cure where appropriate. Upon termination, your access ends and your data is handled per the Privacy Policy retention schedule.
12.3 Effect of termination
- Sections 5 (AI disclaimer), 7 (valuation disclaimer), 10 (intellectual property), 13 (warranty disclaimer), 14 (liability limits), 15 (indemnification), 16 (dispute resolution), and 17 (governing law) survive termination.
13. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- AI Advisor outputs will be accurate, complete, or up to date.
- Defects will be corrected.
- The Service will meet your specific requirements.
Some jurisdictions do not allow the disclaimer of certain warranties; the above disclaimers apply to the maximum extent permitted in your jurisdiction.
13.1 Australian Consumer Law carve-out
For users located in Australia, the following supersedes the disclaimers above to the extent of any inconsistency: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services repaired or replaced if the goods or services fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms purports to exclude, restrict, or modify the application of those statutory consumer guarantees.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- CarFai shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, or vehicle damage, regardless of the legal theory (contract, tort, statute, or otherwise), even if advised of the possibility of such damages.
- CarFai's total aggregate liability to you for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid CarFai in the 12 months immediately preceding the event giving rise to the claim, or (b) USD $100.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages; the above limitations apply only to the maximum extent permitted in your jurisdiction. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited under applicable law.
14.1 EU / UK consumer protection carve-out
For consumers located in the European Economic Area, the United Kingdom, or Switzerland, the following supersedes Section 14 to the extent of any inconsistency: Nothing in these Terms limits or excludes our liability for (i) death or personal injury caused by our negligence, (ii) fraud or fraudulent misrepresentation, (iii) gross negligence or wilful misconduct, or (iv) any other liability that cannot be limited or excluded by applicable mandatory consumer protection law in your country of residence. Consumer-protection rights granted by your local law (e.g., the EU Consumer Rights Directive, the UK Consumer Rights Act 2015, the Swiss Federal Act on the Liability of Defective Products) are not affected by Section 14.
15. Indemnification
You agree to indemnify, defend, and hold harmless CarFai and its officers, directors, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your User Content.
- Your breach of these Terms or the Acceptable Use Policy.
- Your violation of applicable law.
- Your infringement of any third-party right.
16. Dispute resolution
16.1 Informal resolution
Before filing a formal dispute, you agree to attempt informal resolution by contacting [email protected]. We will respond within 30 days.
16.2 Jurisdiction-specific clauses
For users in the United States: any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration administered by JAMS under its consumer arbitration rules. You waive the right to bring claims as a class action or in a representative capacity. This arbitration agreement does not apply to claims that may be brought in small claims court.
For users in the EU or UK: mandatory consumer protection laws of your country of residence apply, and you may also bring claims in the courts of your country.
For consumers worldwide: nothing in this section affects your statutory consumer rights in your jurisdiction.
16.3 Time limitation
Any claim must be brought within one (1) year from the date the cause of action arose, except where applicable law provides for a longer mandatory minimum.
17. Governing law
These Terms are governed by the laws of Quebec, Canada, without regard to conflict-of-laws principles. The choice of law does not deprive consumers of mandatory protections under the law of their country of habitual residence.
18. Apple-specific provisions
If you use the iOS app, the following additional terms apply:
- These Terms are between you and CarFai. Apple has no obligation to provide maintenance or support for the Service.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
- In the event of a Service failure to conform to applicable warranties, you may notify Apple, who will refund the purchase price (if any). Apple has no other warranty obligation.
- Maintenance, support, and product liability claims are addressed by these Terms; Apple is not responsible.
- Compliance with U.S. export law, sanctioned-country lists, and Apple's standard EULA (referenced via
/eula) applies.
19. Changes to the Terms
We may update these Terms. We will notify you of material changes via email and require re-acceptance in-app before continuing use of paid features. Your continued use after the effective date of an update constitutes acceptance.
20. Miscellaneous
- Entire agreement — these Terms, the Privacy Policy, the Acceptable Use Policy, the AI Disclosure, and (for B2B customers) the DPA constitute the entire agreement between you and CarFai concerning the Service.
- Severability — if any provision is held unenforceable, the rest remains in effect.
- No waiver — our failure to enforce a provision is not a waiver of future enforcement.
- Assignment — you may not assign these Terms without our consent. We may assign these Terms to an affiliate or in connection with a merger or sale.
- Force majeure — neither party is liable for delays due to circumstances beyond its reasonable control.
- Notices — we send notices to your registered email or via in-app notification. You send notices to [email protected].
