CarFai End-User License Agreement (EULA)

Effective date: 2026-05-20

This End-User License Agreement ("EULA") is between you and CarFai ("CarFai") and governs your use of the CarFai mobile application ("Software").

1. Apple App Store users — standard EULA applies

If you obtained the Software through the Apple App Store, your use of the Software is subject to Apple's standard End-User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, except as expanded or modified by this CarFai EULA addendum.

Apple is a third-party beneficiary of this EULA and may enforce its terms against you.

2. Google Play users — Google Play terms apply

If you obtained the Software through Google Play, your use is subject to the Google Play Terms of Service (https://play.google.com/about/play-terms/) as expanded or modified by this CarFai EULA.

3. License grant

CarFai grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, solely for personal or internal business purposes (B2B accounts), in accordance with these Terms and the Acceptable Use Policy.

4. Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Software, except where applicable law expressly permits despite this restriction.
  • Modify, adapt, or create derivative works of the Software.
  • Distribute, sublicense, lease, or sell access to the Software.
  • Remove or alter any proprietary notices.
  • Use the Software in violation of applicable export-control or sanctions laws.

5. AI processing — special caveat

The Software uses Anthropic Claude to power AI features. AI outputs are not advice. See /ai-disclosure for the full disclosure.

You acknowledge that:

  • AI outputs may be incorrect, incomplete, or out of date.
  • You are solely responsible for verifying AI outputs before acting on them.
  • CarFai disclaims liability for actions taken in reliance on AI outputs to the maximum extent permitted by law.

6. OBD2 caveat

The optional OBD2 features connect to a Bluetooth OBD2 adapter you provide. Use of OBD2 features requires you to comply with applicable laws (including laws restricting device use while driving). CarFai is not responsible for damage to your vehicle, the adapter, or any third party arising from OBD2 use.

7. Updates

The Software may automatically download and install updates from Apple App Store / Google Play. Some updates may include changes to features or terms; continued use after an update constitutes acceptance.

8. Termination

This license terminates automatically if you breach these Terms. Upon termination, you must cease all use and uninstall the Software. Sections 4, 5, 6, 9, 10, and 11 survive termination.

9. Warranty disclaimer

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, except as expressly required by applicable law or by Apple's or Google's respective terms.

10. Liability limit

To the maximum extent permitted by law, CarFai's liability for any claim arising from or related to the Software is limited as set forth in the CarFai Terms of Service §14.

11. Apple — third-party beneficiary clauses (iOS only)

For users of the Apple App Store version:

  • This EULA is between you and CarFai. Apple is not a party.
  • Apple has no obligation to furnish maintenance or support services for the Software.
  • In the event of a failure to conform to any applicable warranty, you may notify Apple, who may refund the purchase price (if any). Apple has no other warranty obligation in respect of the Software.
  • Apple is not responsible for addressing claims by you or any third party relating to the Software, including product liability claims, regulatory non-compliance, or claims of consumer protection violations.
  • Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim relating to the Software.
  • You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple is a third-party beneficiary of this EULA and may enforce it against you.

12. Governing law

This EULA is governed by the laws of Quebec, Canada, without regard to conflict-of-laws principles, except where local consumer protection laws apply (in which case those laws govern).

13. Entire agreement

This EULA, together with the Terms of Service, Privacy Policy, AI Disclosure, and Acceptable Use Policy, constitutes the entire agreement between you and CarFai concerning the Software.
